2. The petitioner has preferred this application for grant of regular bail in connection with Khagaria P.S. Case No. 60 of 2025 registered for the offences punishable under Sections 126(2), 109, and 3(5) of the BNS and Section 27 of the Arms Act.
3. As per the prosecution's case, the informant has alleged that while he was at his residence, all the accused persons named in the F.I.R. arrived at his house being armed with various weapons. They verbally abused him and opened fire. During the course of incident, a bullet allegedly fired by Vidyarthi Yadav struck his neighbor, Balo Yadav, causing him injuries. The injured was subsequently taken to the hospital for medical treatment.
4. Learned counsel for the petitioner submits that the petitioner is innocent and committed no offence as alleged

From the bare perusal of the F.I.R., it appears that a specific allegation of firing has been made against co-accused Vidyarthi Yadav, as a result of which the informant's neighbor, Balo Yadav, sustained injuries. Learned counsel further submits that the petitioner has merely been alleged to be a member of the mob, and there is no specific allegation against him of having opened fire. It is also submitted that there is case and counter case between both the parties and the petitioner is languishing in custody since 20.02.2025.
5. Learned A.P.P. appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioner.

Keeping in view the aforesaid facts and considering the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S. Case No. 60 of 2025 subject to the condition that one of the bailor shall be his family member. (S. B. Pd. Singh, J) Ankit Kumar/- U T
