The petitioner apprehends his arrest in connection with Awatarnagar P.S. Case No. 64 of 2019 registered under Sections 188, 272, 273, 308 of the Indian Penal Code and section 30, 30(a), 38 of the Bihar Prohibition and Excise Act. Learned counsel appearing on behalf of the petitioner submits that petitioner has no criminal antecedent. He is innocent and has falsely been implicated in the present case. Further submission is that on perusal of seizure list, it appears that the alleged recovery has been made from the outside of the house.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in the

Patna High Court CR. MISC. No.36312 of 2019(3) dt.25-06-2019 2/2 event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-IX-cum-Special Judge, Excise, Saran at Chapra in connection with Awatarnagar P.S. Case No. 64 of 2019, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
