The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and 47A of the Excise Act.

The prosecution case is that from a motorcycle about 14 liters of country made liquor were recovered while being carried on motorcycle, when the motorcyclist escaped from the scene.

Subsequently, during investigation the owner of the motorcycle suggest that the motorcycle was taken by the petitioner for a ride on the alleged date of occurrence.

It is submitted by the learned counsel for the petitioner that police in order to save the owner of the motorcycle has roped the petitioner in the present case.

Patna High Court Cr.Misc. No.6720 of 2016 (2) dt.15-02-2016 Statement has been made in para-3 of the petition that petitioner has no criminal antecedent.

Considering the quantity of recovery and the nature of accusation levelled against the petitioner, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sri R.K. Verma, A.C.J.M.-VI, Buxar in connection with Sikraul P.S. Case No. 72 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
