The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 30(a) and 37(b)(c) of the Bihar Prohibition and Excise Act, 2018. It is a case of recovery of liquor from the hut of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that petitioner has clean antecedent. Learned APP appearing for the State has opposed the prayer for anticipatory bail and submitted that the liquor was recovered from the hut of the petitioner.

After considering the aforesaid facts and

Patna High Court CR. MISC. No.38304 of 2022(2) dt.23-09-2022 2/2 circumstances of the case as well as the fact that the liquor was recovered from the hut of the petitioner, I am not inclined to grant anticipatory bail of the petitioner.

Prayer for anticipatory bail of the petitioner is rejected.
