The petitioner seeks bail in connection with Naubatpur P.S. Case No. 120 of 2024 instituted for the offence under Sections 302, 201 & 34 of the Indian Penal Code. 3.

Prosecution case is that over a trivial dispute, petitioner and other co-accused persons have killed the deceased by cutting his neck.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 28-02-2024. Petitioner bears two criminal antecedent, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's

Patna High Court CR. MISC. No.36737 of 2025(2) dt.18-06-2025 2/3 counsel that petitioner has been falsely implicated in the present case. There is no eye witness to the occurrence. Petitioner has been named merely on suspicion. No occurrence as alleged in the FIR ever took place. Dead body of the deceased was allegedly recovered from Neema Bridge. As per postmortem report, cause of death is hemorrhage and shock due to sharp weapon. Charge-sheet is submitted in this case. 6.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is submitted that deceased came along with the driver at the house of the petitioner and thereafter petitioner along with others have committed murder. Bail of similarly situated co-accused has been rejected by a Co-ordinate Bench of this Court vide order dated 01-10-2024, passed in Cr. Misc. No. 64181 of 2024. 7.

Considering the aforesaid facts and circumstances of the case, there being involvement of the petitioner in this case, coupled with the fact that bail of similarly situated coaccused has been rejected by a Co-ordinate Bench of this Court, this Court is not inclined to grant bail to the petitioner. Prayer for grant of bail to the petitioner is, accordingly, rejected. 8.

The Trial Court is directed to expedite the trial as expeditiously as possible without any undue delay and
