JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-03-2021 Heard Mr. Satyendra Rai, learned counsel for the petitioner and the learned APP for the State. The petitioner seeks bail in anticipation of his arrest in connection with Siwan Muffasil (Mahadewa O.P.) P.S. Case No. 207 of 2020 instituted for the offences under Sections 392 and 411 of the Indian Penal Code. Four persons are said to have made attempts to loot the informant, who was going back home. One of them was said to have been arrested by the police as well as the local persons, who disclosed his name as Rajesh Yadav. The name of the petitioner has transpired in the confession of aforesaid Rajesh Yadav.

The prayer for anticipatory bail is rejected. The petitioner, if so advised, may before the court below and seek bail. In case such a petition is filed, the court below shall take into account all relevant facts and shall pass orders in accordance with law, without being prejudiced by the fact that the present petition for grant of anticipatory bail has not been entertained.
