The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 7 of the Essential Commodities Act.

The prosecution case is that the Block Supply Officer, Simari, Bakhtiyarpur intercepted four trucks each loaded with 31 quintals of wheat in 62 bags, when 98 bags of wheat were recovered from near the house and godown of the petitioner.

It is submitted by the learned counsel for the petitioner that seizure appears that seizure has not been made from the petitioner. The petitioner is not a P.D.S. dealer and seizure list witnesses are not the family members of the

Considering the aforesaid facts, let the above named petitioner be released on bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 493 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
