Petitioner apprehends his arrest in connection with Bairiya P.S. Case No.47 of 2023 dated 27.02.2023, registered for the offence punishable u/s 30(a) of the Bihar Prohibition and Excise Act, pending in the Court of learned Exclusive Special Judge, Excise, Bettiah, West Champaran.

After some arguments, learned counsel for the petitioner seeks permission to withdraw this application. 4.

Permission is granted.

Accordingly, the instant application is dismissed as withdrawn.

However, petitioner is at liberty to surrender before the

Patna High Court CR. MISC. No.37700 of 2023(2) dt.31-07-2023 2/2 learned Court below within six weeks from today and seek regular bail and the learned Court below would pass the order, preferably, on the same day, in accordance with law, without being prejudiced of the withdrawal of this application, considering that petitioner has one criminal antecedent but not of similar nature of offence.
