The instant application for anticipatory bail has been filed by the petitioner apprehending his arrest in connection with Amarpur P.S. Case no. 368 of 2023 instituted for the offence under Sections 307 and 34 of the Indian Penal Code and Sections 25(1-b)a, 26, 27 and 35 of the Arms Act. As per allegation in the FIR, one person was apprehended by the villager when he tried to pull out a lady
Patna High Court CR. MISC. No.40354 of 2024(2) dt.25-06-2024 2/3 from a tempo. During the course, he fired but no one hit. On search, from his possession, one country made pistol along with live cartridge and one mobile phone were recovered. He discloses the name of the petitioner.
Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. Petitioner was not apprehended on spot and also nothing incriminating article has been recovered from his conscious possession. His name has transpired in this case on the basis of confessional statement of co-accused Sahin who has previous enmity with this petitioner and he has already been granted bail by this Court vide order dated 15.12.2023 in Cr. Misc. No. 80853 of 2023.
Having heard learned counsel for the parties and in the facts and circumstances of the case as stated above, this Court is inclined to enlarge the petitioner on bail. The petitioner is directed to surrender in the Court below within a period of four weeks from today and in the event of his arrest or surrender in connection with Amarpur P.S. Case no. 368 of 2023, he will be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka
