The petitioner has preferred this application for grant of regular bail in connection with Alauli P.S. Case No. 376 of 2019 ( G.R. No. 3230 of 2019) dated 03.11.2019 registered for the offences punishable u/ss 406, 420, 467, 468, 471 read with section 34 of the Indian Penal Code.
As per the prosecution case, the allegation against the co-accused persons is of selling the informant's land to the petitioner by tampering with the name of the informant's father,
Patna High Court CR. MISC. No.39776 of 2023(2) dt.12-07-2023 2/3 and the said land pertaining Tauzi No. 3717, Thana No. 199, Jamabandi No. 176, is situated at Mauza - Rampur Chharrapatii. It is further alleged that earlier the co-accused gave the said land on lease for 99 years to one Rahul Kumar Tulsiyan fraudulently after making alteration Jamabandi No. 176 with a view to grab the said land under conspiracy. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is a delay of about one month of lodging the FIR from the date of the incident. The allegation against the petitioner is of purchasing the said land. The petitioner has clean antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 10.02.2023.
Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.
Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Khagaria in connection with Alauli P.S. Case No. 376 of 2019 ( G.R. No. 3230 of 2019), with the condition/s:-

1. The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bond of the petitioner is liable to be cancelled. The application stands allowed.
