JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The victim has already has already returned to his home and the statement of the victim was recorded under section 164 of the Cr.P.C.
Although, the victim supported the story of his kidnapping and forcible marriage with daughter of petitioner no. 1 but submission on behalf of the petitioners is that the victim was in love with the daughter of petitioner no. 1, who was older than the victim and as a matter of fact, the victim solemnized his marriage with daughter of petitioner no. 1 which caused
Patna High Court Cr.Misc. No.57342 of 2015 (2) dt.21-12-2015 2/2 annoyance to the informant and thereafter, the informant lodged this false case. It is further contended that so far as statement of victim is concerned, the victim took U- turn when he returned to his home.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Araria in connection with Bhargama P.S.Case No. 85 of 2014.
