The petitioner, Rakesh Baitha, is in custody in Dumariya Ghat P.S. Case No.6 of 2015 under Section 414, 420, 467, 468, 471, 120(B), of IPC and Section 8/20(b)(ii) (c)/29 of N.D.P.S. Act. According to the prosecution case, the truck which was being driven by this petitioner, 108 k.g. ganja was recovered. The learned counsel for the petitioner submitted that the petitioner was not knowing this fact and in fact he is only a driver of the truck and is in custody since 09.02.2015.
