The petitioner seeks bail in a case registered for the offence under Section 302/34 of the Indian Penal Code. Initially, the F.I.R. was lodged by father of the petitioner against seven other persons, however; during course of the investigation, the F.I.R. named persons were found innocent and this petitioner was found responsible for the alleged occurrence and as such, the police submitted chargesheet against him (petitioner).
It is submitted on behalf of petitioner that F.I.R. named accused and petitioner are agnates and there is case and counter case. Petitioner has been falsely implicated due to ulterior motive. Petitioner is in custody since 01.08.2012.

No.46700 of 2021(3) dt.15-04-2022 2/2 However, learned A.P.P. for the State opposed the bail petition and submitted that during course of the investigation, ample materials have been collected against this petitioner and in different paragraphs of the case diary, it has come that this petitioner committed murder of wife of informant, who is also mother of this petitioner, and a boy aged about 7 years. Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner and same is, accordingly, rejected.
