JUSTICE ASHUTOSH KUMAR ORAL ORDER 15-03-2021 Heard Mr. Sunil Kumar Singh, learned counsel for the petitioner and Mr. Prakash Chandra, learned counsel for the informant. The State is represented by Mr. Satya Nand Shukla, learned APP.

The petitioner seeks bail in anticipation of his arrest in connection with Mahua P.S. Case No. 268 of 2020 instituted for the offences under Sections 147, 148, 149, 447, 323, 324, 307, 379, 504 and 427 of the Indian Penal Code.

The petitioner is alleged to have assaulted the grandson of the informant by means of sharp cutting

Learned counsel for the petitioner has submitted that the aforesaid grandson of the informant has received three injuries out of which two have been opined to be simple and is also stated to have been caused by hard and blunt substance. Injury no. 3 has also been stated to be simple but caused by a sharp cutting weapon.

Considering the aforesaid facts, I am not inclined to grant bail to the petitioner.

The prayer for anticipatory bail is rejected. However, if the petitioner surrenders before the Court below and seeks bail, that petition shall be considered on its own merits, without being prejudiced by the fact that the present petition for grant of anticipatory bail has not been entertained.
