The petitioner apprehends his arrest in Chiraiya P.S. Case No.375 of 2018 registered under Sections 341, 342, 186, 353, 332, 225B, 365, 392, 120B and 34 of the Indian Penal Code.

The informant(Alok Kumar Gurgatiya), Senior Information Officer, Revenue Department alleged that on 15.10.2018, he received a secret information that a Bolero pick up van bearing registration No.BR-06GA-8120 loaded with black pepper was smuggled from Nepal. On such information, the police intercepted the vehicle and sealed black pepper. Rajesh Singh, the driver of the vehicle and Anil Singh, the cleaner of the vehicle were apprehended. The learned counsel for the petitioner submits that petitioner was not apprehended on the spot. The petitioner was engaged in Registry Office, Dhaka. The name of the petitioner surfaced in the case in the disclosure made by the cleaner of the Bolero pick up van from which black pepper was being smuggled but it appears from perusal of the record that cleaner of the vehicle disclosed the entire facts as to how the black pepper was being smuggled. From perusal of the case diary, it further transpires that petitioner and others were involved in smuggling of black pepper from Nepal.

Taking into consideration the facts aforesaid and nature of allegation made against the petitioner, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
