One country made loaded pistol and one live cartridge are said to have been recovered from conscious possession of the petitioner when he along with others assembled to make preparation for committing dacoity for which petitioner is in jail custody since 14.4.2013 (wrongly mentioned in the impugned order as 14.4.2015). The submission on behalf of the petitioner is that having similar allegation almost other co-accused have already been granted privilege of bail and only charge has been framed against the petitioner and there is no likelihood of conclusion of trial of the petitioner in near future.

Taking note of the aforesaid submissions as well as facts

Patna High Court Cr.Misc. No.54155 of 2015 (2) dt.03-12-2015 and circumstances, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Addl.
