This application for grant of anticipatory bail arises out of Obra P.S.Case No. 117/2015, disclosing offences under section 420 of the Indian Penal Code and Section 7 of the E.C.Act. On the basis of a secret information, Block Supply Officer of Obra Block is said to have seized few bags of rice and wheat loaded on a pickup van, which was found parked in front of the shop of the petitioner. The allegation is that the said foodgrains were intended to be sold in black market.

Learned counsel for the petitioner submits that the petitioner is not engaged in any kind of business whatsoever. He is the Headmaster in High School. In any event, he submits that the

Patna High Court Cr.Misc. No.7703 of 2016 (2) dt.28-03-2016 petitioner is not likely to flee away from the course of justice, if he is granted privilege of anticipatory bail. The petitioner has no criminal antecedent, as stated in paragraph 3 of this application. Considering the above, this application is allowed. Let the petitioner, abovenamed, in the event of his arrest/ surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in Obra P.S.Case No. 117/2015, subject to the conditions as laid down under section 438 of the Cr.P.C.

This is subject to the condition that the petitioner shall present himself before the police/ court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bonds shall be liable to be cancelled.
