Heard the learned counsel for the petitioner and the learned A.P.P. for the State. 2.

The petitioner apprehends his arrest in connection with Saur Bazar (Patarghat O.P.) P.S. Case No. 456 of 2022, registered for the offences punishable under Sections 366(A), 363 and 120(B) of the Indian Penal Code.

It is alleged by the informant that on the alleged date and time of occurrence the petitioner herein along with one another co-accused person had kidnapped the minor daughter of the informant, whereafter she was taken to Nepal for the purposes of solemnization of unlawful marriage.

The learned counsel for the petitioner has submitted that the petitioner is innocent, he has been falsely implicated in the present case and he is having a clean antecedent. The learned counsel for the petitioner has further submitted that the act was consensual and in fact the petitioner has not been alleged to have committed any untoward incident with the daughter of the informant.

Per contra, the learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the parties and taking into account the materials available on record as also considering the facts noted in the impugned order dated 18.04.2023, prima facie the complicity of the petitioner in the alleged occurrence is writ large from the record and he has admittedly kidnapped the minor daughter of the informant, thus the present case is not at least a
