Heard the parties.
The petitioners are languishing in custody for the offence punishable under Section 414/34 of the Indian Penal Code and Sections 30(a) and 41(1) of the Bihar Prohibition and Excise Act.
Submission is that petitioners were not there at the time of recovery of liquor. Petitioners have been implicated on the basis of confessional statement of co-accused. Petitioners are in custody since 23.07.2020. Investigation of the case is already complete.
Patna High Court CR. MISC. No.33862 of 2020(2) dt.22-12-2020 2/2 Considering the entire facts aforesaid, let the petitioners, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Courtbelow where the case is pending in connection with Kudhani P.S. Case No. 331 of 2020, with following conditions: (a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.
(b) The petitioners shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioners.
(c) The petitioners shall not leave the country without permission of the trial Court.
