The petitioner is in custody in connection with Kuchaikote P.S. Case No.68 of 2019 for the offences under Sections 30(a), 32 (2), 38(i) and 41(i) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 05.03.2019. He further submits that in the instant case total 2610.720 liters liquor was seized but not from the conscious possession of the petitioner.

Considering the fact that the petitioner has got no criminal antecedent and nothing was recovered from his possession, the Court is inclined to grant bail to the petitioner.

No.35304 of 2019(2) dt.29-05-2019 2/2 Let the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District Judge-cum-Special Judge, Excise, Gopalganj, in connection with Kuchaikote P.S. Case No.68 of 2019.
