The petitioner apprehends his arrest in a case registered for the offence under Section 307 & other allied sections of the Indian Penal Code.
The allegation against petitioner is that the accused persons including petitioner abused the informant and thereafter, entered in his courtyard and assaulted him. Petitioner assaulted informant by means of farsa on his forehead, due to which, he fell down and when other family members of informant came to save him, they were also assaulted by accused persons by fists and slaps.
It is submitted on behalf of petitioner that there is case and counter case. The matter has been compromised by the
Patna High Court CR. MISC. No.47137 of 2021(4) dt.25-07-2022 2/2 parties before the court below. Both parties are next door neighbour and due to petty dispute, the scuffle took place. Petitioner claims clean antecedent.
Learned A.P.P. for the State has opposed the bail petition.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of his arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Supaul in connection with Kishanpur P.S. Case No. 19 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
