The petitioner seeks bail in a case instituted for the offences under Section 302/34 of the Indian Penal Code and 27 of the Arms Act.

The prosecution allegation in short is that while the informant was sleeping along with family members at his house, the accused persons came into the house and opened fire upon the son of the informant due to which he sustained and later succumbed to death.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 5.11.2018 and has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. Charge-sheet has been

The allegation of firing is against co-accused namely Mahesh Yadav, Sarjan Yadav, Kishori Yadav, Chandan Yadav and Bhopal Yadav which led to the death of deceased. The petitioner is said to be member of unlawful assembly. No injury is attributed against the petitioner. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, it is directed that the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-1st, Lakhisarai in connection with Kajra P.S. Case No. 20/2018 (S.T. No. 33/19).
