The petitioner seeks bail in Laukahi P.S. Case No. 01/2013 corresponding to S.T. No. 412/2013 registered under Sections 304B, 201, 120B of the Indian Penal Code. Earlier the prayer for bail of the petitioner was rejected vide order dated 18.12.2014 passed in Cr. Misc. No. 28606/2014. The informant made allegation against the petitioner that he killed his wife and his child who was in the lap. It is submitted that out of 11 witnesses, 5 witnesses have been examined, who did not support the prosecution case.

Considering the facts aforesaid and the nature of allegation, I am not inclined to enlarge the petitioner on bail in Laukahi P.S. Case 01/13. Accordingly, the same is rejected. The trial court is directed to expedite the trial holding it

Patna High Court Cr.Misc. No.55938 of 2015 (2) dt.04-05-2016 2/2 on day-to-day basis and conclude the same within six months from the date of receipt/production of copy of this order. The Superintendent of Police, Madhubani is directed to produce all the remaining prosecution witnesses of S.Tr. 412/2013 arising out of Laukahi P.S. Case No. 1/2013 so that the trial must be concluded within stipulated time.

Let a copy of this order be sent to the S.P. Madhubani for compliance of the order.
