2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 310(4), 310(5) of the B.N.S. and Sections 25(1-b)a/26/35 of the Arms Act.

3. The case of the prosecution is that from possession of this petitioner, one loaded country made pistol was recovered.

4. Learned counsel for the petitioner has submitted that the allegations are only of arms act but police had given a colour of Sections 310(4) and 310(5) of the BNS to aggravate the matter. It has also been submitted that similarly situated coaccused Karan Kumar has been granted bail by the learned Coordinate Bench vide Cr.Misc. Case No. 35506 of 2025. The case

Patna High Court CR. MISC. No.40962 of 2025(3) dt.20-08-2025 2/2 of this petitioner stands on similar footing. The petitioner is a man of clean antecedent. The petitioner is in judicial custody since 06.03.2025.

5. Learned APP for the State has vehemently opposed the bail.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Aurahi P.S. Case No. 50 of 2025 (G.R. No. 975/2025) on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate- 1st Class, East Muzaffarpur.
