JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner happens to be father of deceased and according to prosecution case itself, informant is not an eye witness of the alleged occurrence. Furthermore, it would appear from perusal of the first information report that deceased died on 06.04.2015 and subsequently, his dead body was cremated but informant, who happens to be father in law of the deceased, lodged this case on 01.05.2015 and no explanation regarding the aforesaid delay was given.
The contention on behalf of the petitioner is that as a matter of fact, informant pressurized the petitioner to transfer his entire property in the name of sons of deceased but when
Patna High Court Cr.Misc. No.54075 of 2015 (2) dt.02-12-2015 2/2 petitioner refused to transfer his entire property in the name of sons of the deceased, the informant lodged this false case. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge, Saran at Chapra in connection with Ekma P.S. Case No. 51 of 2015 corresponding to Sessions Trial No. 1184 of 2015(497 of 2015).
