1. Heard learned counsel for the parties.

2. The petitioners in this application pray for bail apprehending their arrest in connection with Gamhariya P.S. Case no.232 of 2024 registered for the offence punishable under sections 126(2), 115(2), 118(1), 74, 303(2), 352 and 3(5) of the Bharatiya Nyaya Sanhita, 2023.

3. As per the prosecution case, the informant states that on the date and time fixed, there was a panchayati held

It is stated that soon after the panchayati, the fifteen named accused persons including the seven petitioners herein started to abuse and assault the informant and others. It is stated that on the orders of the petitioner no.1, Arun Rai assaulted the sisterin-law of the informant with a dabiya causing injuries on her head. Others were also assaulted.

4. Learned counsel for the petitioners submits that the petitioners have been falsely implicated in the case. While the petitioner no.1 is said to be an order giver, the allegations against others are general and omnibus in nature. So far as Arun Rai is concerned, he is not a petitioner herein. There is case and counter case between the parties and the petitioners have no criminal antecedent.

5. The application for bail is opposed by learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioners in the FIR, the specific allegation being against co-accused Arun Rai and not the petitioners herein together with the petitioners not having any criminal antecedent, it is directed that all the seven petitioners, above named, in the event of their arrest or

Case no.232 of 2024 on each of them furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate VI, Madhepura.
