2. The petitioner seeks bail in connection with Mahua P.S. Case No. 290 of 2015 dated 15.06.2015 registered for the offence punishable under Sections 363, 366, 366(A)/34 of the Indian Penal Code.

3. The petitioner along with co-accused persons named in the F.I.R. is alleged to have kidnapped the daughter of the informant for illegal work.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. It is submitted that the F.I.R. has been lodged against five named accused persons. The petitioner is not

In the statement of victim recorded under Section 183 of B.N.S.S. she has stated that the petitioner and others were involved in getting her marriage solemnized with one Rajan Kumar and except this allegation, there is no material to connect the petitioner with the alleged kidnapping of the victim. It is further submitted that the petitioner is aged about 65 years and the petitioner is father of co-accused Khusboo Kumari, who is named accused in the F.I.R.. It is submitted that the victim girl was examined and her age was assessed as 18 years and she has stated her age as 19 years in her statement recorded under Section 183 B.N.S.S.

Further, it is submitted that similarly situated person, namely, Pritesh Kumar @ Pertesh Kumar has been granted bail vide order dated 06.08.2025 passed in Criminal Miscellaneous No. 31805 of 2025 by a co-ordinate Bench of this Court. Lastly, it has been submitted that the petitioner is in custody since 11.01.2025, having no criminal antecedent and charge-sheet has been submitted in the case.

5. Learned A.P.P for the State opposes the prayer for bail of the petitioner.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, let the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Vaishali at Hajipur in connection with Mahua P.S. Case No. 290 of 2015.
