JUSTICE VINOD KUMAR SINHA ORAL ORDER 04-11-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 708 C of 2018, disclosing offences under Sections 3420, 467 and 468 of the Indian Penal Code.

As per complaint petition, petitioner got sale deed executed from the complainant on the plea of providing old age pension to him.

Submission of learned counsel for the petitioner is that allegation is false and concocted, which will appear from the fact that son of the complainant has also filed a title suit against the petitioners and the complainant with respect to land

Patna High Court CR. MISC. No.36116 of 2019(6) dt.04-11-2019 2/2 in dispute and the case is purely of civil nature. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria, in connection with Complaint Case No. 708 C of 2018, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
