The present application has been filed for seeking direction to respondent no.11 Block Development Officer, Kaler, Arwal district to pay the salary for the period of 01.05.2004 to 31.05.20224, 01.02.2005 to 10.02.2005,

Patna High Court CWJC No.728 of 2021(9) dt.02-01-2023 2/3 01.02.2006 to 31.07.2007, 23.10.2007 to 05.11.2007, 02.05.2008 to 08.05.2008, 16.05.2008 to 20.05.2008 and 03.06.2008 to 20.06.2008 and further to direct the respondent no.8 DPFO Jehanabad to issue a authority slip for payment of G.P.F. to the petitioner.

Learned counsel for the State has appeared and filed his counter affidavit on behalf of the respondent nos.5 to 11 as well as the counter affidavit filed by the respondent nos.4 to 8 by DPFO, Jehanabad .

Admittedly the present writ petition has been filed by the wife of the employee. According to her, her husband was appointed on 15.05.2000 and died on 18.11.2014, after death the P.P.O. and G.P.O. has been issued.

Counsel for the petitioner submits that her husband did not receive the dues payment of salary and GPF amount. In this regard the series of correspondence were made between the officials. Lastly the petitioner has represented on 14.08.2020 for payment of legal dues which has not been paid to her. There are series of letters and reply attached in this writ petition by way of counter affidavit also.

For the purpose of deciding this disputes the official records are required.

Patna High Court CWJC No.728 of 2021(9) dt.02-01-2023 3/3 In this view of the matter, the District Magistratecum-Collector, Arwal district is directed to resolve the present issue within period of 60 days from the date of receiving of the representation by the petitioner, considering all the documents annexed in the writ petition which shall be placed before him by the petitioner. It is also directed to the District Magistrate-cumCollector, Arwal district that in case of admitted dues he shall assure payment within 60 days thereafter.
