The petitioner being the husband of the victim is languishing in custody since 10.10.2018 in a case registered for the offences punishable under Sections 306 and 498A of the I.P.C.

The prosecution case is that the informant Arjun Ravidas was informed by his wife that his daughter Kajal is not opening the door. Subsequently, the door was broke open and it was found that the daughter of the informant has committed suicide. It is alleged that the accused persons inflicted torture for nonpayment of the money demanded by the husband, leading to registration of FIR under Sections 306 and 498A of the IPC. It is submitted by learned counsel for the petitioner that

Patna High Court CR. MISC. No.35252 of 2019(2) dt.29-05-2019 2/2 the victim was married with the petitioner ten years prior to the lodging of the case and the victim committed suicide. It is further submitted that after investigation, charge sheet has been submitted under Section 306 of the IPC.

Learned APP submits that the victim was tortured by the accused persons including the petitioner being husband of the victim.

Considering the nature of accusation, the period in custody, coupled with the fact that investigation has already been concluded, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge IX, Patna in connection with Patrakar Nagar P.S.
