JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. There is accusation against the petitioner that he kidnapped informant's minor daughter, who was subsequently recovered and her statement was recorded under section 164 of the Cr.P.C. The victim stated about her kidnapping by the petitioner in her statement recorded under section 164 of the Cr.P.C. The victim was found minor but submission on behalf of the petitioner is that according to the prosecution case itself, the victim was kidnapped on 27.07.

2015 but the first information report was lodged on 3.10.2015, particularly, in the circumstance when the wife of the petitioner lodged the case against the prosecution party in respect of kidnapping of the petitioner.

Patna High Court Cr.Misc. No.54410 of 2015 (2) dt.07-12-2015 2/2 of the petitioner which is evident from perusal of the impugned order itself.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate V, Kartihar in connection with Barari ( Semapur) P.S.Case No. 184 of 2015,G.R.No.2929 of 2015.
