JUSTICE DINESH KUMAR SINGH ORAL ORDER 18-01-2017 The present application has been filed for modification of the order dated 01.07.2016 passed in Cr. Misc. No. 27045 of 2016, whereby the petitioner was granted provisional anticipatory bail for three months in a case registered for the offences punishable under Section 135 of the Electricity Act. The provisional bail was to be confirmed by learned Court below on deposit of 30% of the loss/calculated amount.

It is submitted by learned counsel for the petitioner that 30% of the loss/calculated amount has already been deposited though not within a period of three months. The above contention of the counsel for the petitioner has not been controverted by Mr. Ajay Kumar Gautam, learned counsel appearing for the South Bihar Power Distribution Company Limited.

Patna High Court Cr.Misc. No.55272 of 2016 (2) dt.18-01-2017 2/2 It is further submitted by learned counsel for the petitioner that bail bond of the petitioner has still not been cancelled.

In the circumstances, the provisional bail granted to the petitioner is extended till 20th of February, 2017. Learned Court below will be at liberty to confirm the provisional bail of the petitioner on verification of the fact that petitioner has already deposited the above mentioned amount.

Accordingly the modification application is disposed of in connection with Makhdumpur P.S. Case No. 397 of 2015, pending in the Court of learned Special Judge(Electricity), Magadh Area, Gaya.
