JUSTICE RAKESH KUMAR ORAL ORDER 18-12-2015 Heard Sri Ranjeet Kumar Singh, learned counsel for the petitioner, Sri Ram Chandra Singh, learned Addl. Public Prosecutor and learned counsel, who has voluntarily appeared on behalf of the informant.

The petitioner, who is in custody since 15.10.2015 in connection with Khagaria P.S. Case no.515/2015 registered for the offence under Sections 420,461, 467, 468, 471, 406, 120 of the Indian Penal Code , has prayed for grant of bail. It was submitted by learned counsel for the petitioner that in a civil dispute, colour of criminal offence has been given and the petitioner has been taken in custody on 15.10.2015. Learned counsel for the informant has vehemently opposed the prayer for bail of the petitioner. He submits that

Patna High Court Cr.Misc. No.55387 of 2015 (2) dt.18-12-2015 2/2 without holding the account number, the petitioner had issued cheque of Rs.7 lacs in favour of the informant, which was bounced. He has argued that in such serious accusation of cheating, the petitioner may not be enlarged on bail. In view of nature of accusation as well as the fact that the dispute is in relation to registration of immovable property as well as the period of custody, let the petitioner, namely, Binod Kumar Singh @ Pappu be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Khagaria P.S.
