Mr.Lalit Kishore (Ag) ====================================================== CORAM: HONOURABLE MR. JUSTICE P. B. BAJANTHRI ORAL JUDGMENT Date : 17-01-2022 The matter is heard via video conferencing due to circumstances prevailing on account of the COVID-19 pandemic.
2. In the instant petition, petitioners have prayed for the following relief/reliefs:
"A. For quashing the examination Sub-inspector of Police held on 22.12.2019 against the advertisement no. 01/2019 as contained in Annexure 1 and subsequently result published by Bihar Police Sub-ordinate Service Commission, Patna herein referred in short Commission on 28.01.2020 to the post of Sub-inspector of Police as contained in Annexure 7.
B. To hold and declare examination conducted by the Commission on 22.12.2019 to the post of Sub inspector of Police as contained in Annexure 1 and result published on 28.01.2020 as contained in Annexure 7 is based on large scale malpractice, leakage of question paper on social media at 1:42 pm, 1:46 pm, 1:47 pm and not free from doubt and large scale of unfair means and telecast by Zee Bihar News Channel. C. Also for quashing notice as contained in Annexure 8 by which date of main competitive examination of Sub Inspector of Police against advertisement as contained in Annexure 1 has been fixed on 12.10.2020.
D. Also commanding the respondents to inquire into the matter by independent agency i.e. CBI about large scale of mis-affair means, malpractice committed, leakage of question paper on the date of examination i.e. 22.12.2019 which became viral at 1:42 pm, 1:46 pm, 1:47 pm and role attributed by commission in not cancelling the examination held on 22.12.2019 against the advertisement 01/2019 to the post of police sub-inspector and publishing the result as contained in Annexure 7.
4/4 E. Also commanding the respondents to ensure free, fair transparent examination and fresh examination to the post of Sub-inspector of Police against the advertisement 01/2019 in order to maintain the confidence to the students and public.
F. Also if any appointment is made during pendency of this writ application on the basis of examination held on 28.1.2020 against the advertisement as contained in Annexure 1 is fit to be quashed.
G. Also for necessary relief/reliefs, order/orders direction/directions for which the petitioner is entitled in the eye of law."
3. Undisputedly, petitioners have not impleaded last candidate in the respective category as necessary and proper party. In the light of Apex Court decision in the case of Ranjan Kumar v. State of Bihar reported in (2014) 16 SCC 187 (para Nos. 4 to 13), the petitioners have not made out a case.
4. Accordingly, writ petition stands dismissed, reserving liberty to the petitioners to file fresh petition in accordance with law.
