In this case, the petitioner was running a P.D.S. shop, on account of illness, he stopped to function since 2001, when he recovered from illness, he filed an application before the S.D.O., Sitamarhi with a prayer to renew the P.D.S. licence either in his name or in the name of his son. Learned counsel for the petitioner further submits that though the petitioner has filed a representation in this regard but, the same is pending till date. He further submits that he is ready to even pay the licence fee with fine as the entire life is dependent on the generation of fund by running the P.D.S. shop.
Patna High Court CWJC No.14872 of 2016 dt.27-04-2017 In that view of the matter, the S.D.O., Sitamarhi is directed to decide the representation of the petitioner, which is pending before him, by passing a reasoned order in accordance with law. Before passing a final order, the S.D.O., Sitamarhi must given an opportunity of hearing to the petitioner.
With the aforementioned observation and direction, this application is disposed of.
