JUSTICE ASHUTOSH KUMAR ORAL ORDER 21-09-2022 Twice the prayer for bail of the petitioner was rejected by this Court on 31.08.2020 (Cr. Misc. No. 16539 of 2020) and 24.11.2021 (Cr. Misc. No. 37250 of 2021).

This Court had called for a report from the court below about the stage of the case. The report which is kept at 'flag-A' discloses that all the prosecution witnesses including the doctor and the I.O. have been examined and the case is pending only for defence evidence.

It has been observed by the learned trial court

Patna High Court CR. MISC. No.37976 of 2022(3) dt.21-09-2022 2/2 that if the parties cooperate, the case shall be disposed of without any delay.

In view of such report of the trial court, I am not inclined to direct for release of the petitioner. The trial court shall not permit any unnecessary adjournment and shall conclude the trial positively within a period of four months, failing which the petitioner shall have the liberty to approach this Court again.
