24-07-2019 At the very outset, learned counsel for the petitioner requests for allowing him to make correction in the first paragraph and prayer portion of the petition to the extent of correcting the name of the court, where the case is pending. The prayer is allowed. It may be done in course of the day.
Heard Sri Mukesh Kumar, learned counsel for the petitioner and Sri Uday Chand Prasad, learned Addl. Public Prosecutor.
This is the 2nd attempt for grant of bail on behalf of petitioner. Lastly, on 19-12-2018, vide Cr. Misc. No. 69705 of 2018, the prayer for bail of the petitioner was rejected granting liberty to renew the prayer for bail after completion of nine months in custody and as such, after completion of nine months in custody, the present bail petition has been filed. Patna High Court CR. MISC. No.35024 of 2019(4) dt.24-07-2019 2/2 filed on behalf of petitioner and ordersheet of the court below has been brought on record.
Learned counsel for the petitioner submits that in this case, save and except order of cognizance, no further appropriate proceeding has taken place.
Learned Addl. Public Prosecutor has opposed the prayer for bail.
Besides hearing, I have also perused the material on record.
In view of the fact that on last occasion, liberty was granted to the petitioner to renew the prayer for bail after completion of nine months in custody as well as the fact that before the court brelow, the case has not proceeded properly, there is no reason to further detain the petitioner in custody. Let the petitioner namely Sintu Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Miss Anjali Nag, J.M. IInd Class, Vaishali at Hajipur/concerned court in connection with Industrial Area Hajipur P.S. Case No. 64 of 2018.
