JUSTICE SUDHIR SINGH ORAL ORDER 09-03-2016 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 302 and 34 of the Indian Penal Code. As per prosecution case, informant's husband and son were sleeping in the Basha at night and in the morning their dead bodies were found in the nearby areas.
It is submitted on behalf of the petitioner that he has got no criminal antecedent. He is not named in the F.I.R. There is no specific evidence to suggest his implication in the present case. From perusal of paras-8, 9 and 10 of the case diary it is evident that merely on suspicion petitioner has been made accused. On behalf of the State, it is submitted that petitioner is not named in the F.I.R. His name has come in course of investigation.
Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest or surrender in the court below within a period of six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two
Patna High Court Cr.Misc. No.8184 of 2016 (3) dt.09-03-2016 2/2 sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur, in connection with Sultanganj P.S.
