JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. According to prosecution case itself, the victim was taken away by FIR named accused, Arvind Ram and Jagdeo Prasad. Co-accused, Arbind Ram happens to be grand son of the petitioner.
The accusation against petitioner is that when informant went and inquired about the whereabouts of victim from this petitioner and others, petitioner and others abused and chased him for beating. The petitioner does not have any criminal antecedent and the impugned order of learned Sessions Judge reflects that except the above-said averments, prosecution witnesses stated nothing against the petitioner. Moreover, investigation against
Patna High Court Cr.Misc. No.54371 of 2015 (2) dt.07-12-2015 2/2 petitioner has already been completed.
Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Madhuban P.S. Case No. 134 of 2015 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikrahana, East Champaran, Motihari.
