JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-12-2015 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. Neither the petitioner was caught at the spot nor anything has been recovered from his possession and he has been implicated in this case only on the basis of suspicion though the informant claims to identify the petitioner. The petitioner does not have any criminal antecedent and he is languishing in jail custody since 10.09.2015.

Accordingly, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M. East Champaran at Motihari in Motihari Town P.S. Case No. 152 of 2015.
