2. The petitioner seeks regular bail in connection with Katihar (Muffasil) P.S. Case No. 83 of 2023 dated 28.04.2023, lodged under Sections 302, 307, 326, 354(B), 34 of the Indian Penal Code.

3. Learned Counsel for the petitioner submits that the bail application of the petitioner has earlier been rejected vide order dated 06.12.2023 passed in Cr. Misc. No. 64511 of 2023 with liberty granted to the petitioner to renew his prayer for bail after framing of charge. Counsel submits that the direct allegation of stabbing knife to the informant's son was against Md. Sahnawaz and Md. Siroj. Counsel further submits that other co-accused persons have been granted bail by the Co-ordinate

Patna High Court CR. MISC. No.46703 of 2024(4) dt.27-09-2024 2/2 Bench of this Court which is annexed as Annexure-4 series of the present bail application.

4. Learned Counsel for the petitioner further submits that the criminal antecedent of the petitioner is clean and he is in custody since 29.04.2023. Counsel submits that on previous occasion, progress report of the trial has been called for and from the said report, it transpires that there were five witnesses, summons have been issued to all and charge has already been framed.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the present facts and circumstances of this case, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty Thousand) with two sureties of the like amount each to the satisfaction of Additional District & Sessions Judge-II, Katihar in connection with Katihar (Muffasil) P.S. Case No. 83 of 2023, subject to the conditions as laid down U/s 437(3) Cr.P.C.
