The petitioner seeks for bail in connection with Surajgarha P.S. Case No.145 of 2023, registered for the offence punishable under Sections 448, 323, 307, 387, 354(A), 504, 506/34 of the Indian Penal Code and Section 27 of Arms Act. 3.

As per the FIR, the allegation against the petitioner is that he has demanded extortion of Rs.20 lakhs from the informant and has also fired upon the informant and his son. 4.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. No such occurrence, in the manner as alleged, has ever taken place. The allegation

Patna High Court CR. MISC. No.39558 of 2024(3) dt.30-08-2024 2/2 levelled against the petitioner is not specific rather general and omnibus in nature. There is no specific overt act against the petitioner. Petitioner is in judicial custody since 03.02.2024. Petitioner has 13 criminal antecedents.

Learned APP for the State opposed the prayer for anticipatory bail.

Having regard to the facts and circumstances of the case as well as considering the nature of offence, I am not inclined to enlarge the petitioner on bail. The prayer for grant of bail on his behalf is hereby rejected.

Accordingly, this application is dismissed.
