KUMAR ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 20-02-2020 This petition was registered Suo Motu on the basis of news item dated 20.06.2018 with the caption of '40,000 Class X answer sheets disappear from Gopalganj'.

From the response filed by the State, it is evident that the action stands taken. Relevant averments of the affidavit dated 25.08.2018 filed by Respondent No. 3, paras 4 and 5, are extracted hereinbelow:

"4. That in the said report a detail information with respect to this mishappening has been elaborately reported and on that very premise the Hon'ble Court has pleased to take cognizance on the issue in question vide its order dated 22.06.2018 and has directed to State Respondent to file action taken report with regard to the issues in question.

5. That since the issue in question is directly related with Bihar School Examination Board

Patna High Court CWJC No.11356 of 2018(3) dt.20-02-2020 2/2 and accordingly the Bihar School Examination Board has taken action with respect to the issue, on query from the State Respondent Bihar School Examination Board has informed the answering deponent vide his letter no. 437 dated 19.07.2018, that D.M/S.P., Gopalganj has been directed to investigate the issue in question and to submit an action taken report. It is further relevant to submit here that the issue in question has also been investigated at the level of the Board also whereby and whereunder the report published in the newspaper seems to be correct and accordingly the F.I.R. has been registered and the Principal of the School in question being a Centre Superintendent has been arrested and further investigation is in process, however, the report from the D.M. is still awaited."

As such with the passage of time the action having been taken.

The present application stands disposed off.
