JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 15-12-2015 Heard learned counsel for the petitioners and learned counsel for the State.
The petitioners seek bail in connection with Kanti P.S. Case No.224 of 2015 registered under Sections 25(1-B)(a), 26 and 35 of the Arms Act.
According to the first information report, one country made loaded pistol was recovered from possession of each of the petitioners. It is contended that the allegations made in the FIR are not true. The petitioners are innocent and have been falsely implicated in the case. They have got no criminal antecedent. They have been implicated in the case due to high handedness of the police.
Patna High Court Cr.Misc. No.56059 of 2015 (2) dt.15-12-2015 2/2 Learned counsel for the State has opposed the application filed on behalf of the petitioners for grant of bail. Taking into consideration the recovery of one country made loaded pistol from possession of each of the petitioners, I am not inclined to grant them bail. Accordingly, their prayer for bail is rejected.
In case the trial is not concluded within six months from the date of receipt/production of a copy of this order, the petitioners would be at liberty to renew their prayer for bail. (Ashwani Kumar Singh, J) Md.S./- U T
