JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-06-2024 The present petition has been filed for modifying the order dated 6.11.2020, passed by this Court, in Criminal Miscellaneous No. 14650 of 2020, to the extent that the condition imposed upon the petitioner regarding marking his attendance before the Officer-in-Charge of the concerned Police Station at 10:00 am on every Monday of the week be directed to be relaxed and instead the petitioner be permitted to mark his attendance before the Officer-in-Charge of the concerned police station, once every three months.

The learned counsel for the petitioner submits that all throughout the petitioner has been putting his attendance before the Officer-in-Charge of the concerned Police Station at 10:00 am on every Monday of the week and has not committed any

No.44108 of 2024(2) dt.21-06-2024 2/3 default, apart from the fact that he is having a clean antecedent and this Court had otherwise also found merit in his case so as to warrant grant of privilege of bail to him, thus, keeping in view the aforesaid facts, the petitioner be granted liberty to mark his attendance before the Officer-in-Charge of the concerned Police Station once every three months so that he can venture outside the State of Bihar for his livelihood and to that extent, the condition imposed vide order dated 6.11.2020 be modified.

Per contra, the learned APP for the State has submitted that it appears that the petitioner has not defaulted in complying with the condition imposed upon him, vide order dated 6.11.2020, apart from the fact that he is having a clean antecedent, hence, a sympathetic view may be taken. 4.

Having regard to the facts and circumstances of the case, I deem it fit and proper to modify the order dated 6.11.2020 to the extent that the petitioner shall now be required to mark his attendance before the Officer-in-Charge of the concerned Police Station once every three months, starting from 1st of July, 2024. Rest of the order dated 6.11.2020 shall remain as it is. 5.

Accordingly, the present modification petition stands disposed off with the aforesaid modification in the order dated
