Petitioner seeks bail in a case under Sections 498A, 379, 323, 452 and 504/34 of the Indian Penal Code. There is allegation of giving blow by iron rod on the head of the victim wife.

Learned counsel for the petitioner submits that the injury suffered by the victim is simple, which has not been contradicted by the learned counsel for the State. In the facts and circumstances of the case, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief

Patna High Court Cr.Misc. No.54475 of 2015 (3) dt.16-02-2016 2 /2 Judicial Magistrate, Araria in connection with Forbesganj Police Station Case No. 378 of 2015, subject to the condition that he will either keep the victim with due dignity or if for any reason the victim is not ready to live with the petitioner, petitioner shall pay maintenance amount of Rs. 1500/- (fifteen hundred) per month to the victim wife, as it is stated that she is living with a child. The said amount shall be paid within one month of the release of the petitioner and the trial court shall confirm the bail bond of the petitioner on payment of the first instalment.
