In this case, the petitioner is seeking bail in connection with Ghorasahan P.S. Case No. 39 of 2012 for offence under Sections 302/120B/327/34 of the Indian Penal Code. Earlier, this Court vide order dated 22.4.2015 in Cr. Misc. No. 8215 of 2015 had refused to grant bail to the petitioner and had directed the court below to conclude the trial within six months.

In the present case, this Court, vide order dated 20.1.2016, had called for a report from the court below and the report of the court below dated 28.1.2016 shows that out of fifteen prosecution witness, nine witnesses have already been examined.

Patna High Court Cr.Misc. No.55502 of 2015 (3) dt.17-02-2016 It is expected that the court below will complete the trial of the petitioner within a period of six months from the date of receipt/production of a copy of this order. At this stage, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, namely, Raj Kapoor Mahto is rejected with a direction to the trial court to conclude the trial within the aforementioned period of six months.
