JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-02-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341,323,324,379 and 307/34 of the Indian Penal Code.
The prosecution case is that on 17.9.2015 at 6.30 P.M. the informant's brother Faiz Ahmad was coming home after getting his mother examined by the doctor when the FIR named accused persons including the petitioner surrounded the brother of the informant who was assaulted by co accused Syeed Alam by garasa causing injury on head when he fell down then this petitioner snatched gold chain from the neck of the informant's brother.
It is submitted by the learned counsel for the petitioner
Patna High Court Cr.Misc. No.9143 of 2016 (2) dt.29-02-2016 2/2 that for a petty dispute accusation has been levelled against the petitioner being neighbour of the informant. The accusation of assault is not against the petitioner. Statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned JM Ist Class, Sitamarhi, in connection with Parsauni P.S. Case No. 105 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
