The petitioner seeks bail in connection with a case registered for the offence punishable u/s 302, 201/34 of the IPC. 3.

As per the prosecution case, the daughter of the informant was found dead and her dead body was recovered from a pond. The informant has alleged that the there was love affair between his daughter and the petitioner and has raised suspicion that the petitioner has killed her.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence as alleged in the FIR. He has been falsely implicated in this case due to enmity. There is general and omnibus allegation against the petitioner. There is no eye witness to the alleged occurrence.

Patna High Court CR. MISC. No.39499 of 2024(2) dt.31-07-2024 2/2 Petitioner has been made accused only on the basis of suspicion. The petitioner has one criminal antecedent and has been rotting in judicial custody since 04.01.2024.

Learned APP for the State opposed the prayer for bail. 6.

Considering the facts and circumstances of this case, I am not inclined to enlarge the petitioner on bail. 7.

Accordingly, this application is dismissed.

However, petitioner is at liberty to renew his prayer for bail after framing of charges.
