The petitioner, Sundeshwar Mukhiya @ Chandeshwar, is in custody, in Sessions Trial No.142 of 2015 arising out of Muzaffarpur Rail P.S. Case No.62 of 2013, since 12.01.2014. The learned counsel for the petitioner submitted that the FIR is against unknown and the petitioner has been named by accused in his confessional statement and the co-accused who claimed the other co-accused and this petitioner has already been granted bail by this Court in Cr. Misc. No.34968 of 2015 on 05.08.2015. Considering the above facts and that the petitioner is in custody since more than one year, I direct that the above named

Patna High Court Cr.Misc. No.55706 of 2015 (2) dt.17-12-2015 2/2 petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) with two sureties of the like amount each to the satisfaction of learned 4th Addl. Sessions Judge, Muzaffarpur in connection with S.Tr. No.142 of 2015 arising out of Muzaffarpur Rail P.S. Case No.62 of 2013 on condition that one bail should be local bailor and other should be close relative of the petitioner.
